It seems like a simple thing to choose, but it&#8217;s a big one in the long run. The Tax Institute has some helpful information for you.\u00a0<\/em><\/p>\n<p>Your tax filing status is one of the most important decisions you\u2019ll make in filing your return. It determines your standard deduction, as well as other deductions and credits. So, don\u2019t take it lightly.<\/p>\n<p>In some cases, the filing status you need to use is crystal clear. In other cases, it\u2019s a bit tricky. No matter how complicated it is, you usually determine it based on your status as of the last day of the year. For this year, that would be Dec. 31, 2025.<\/p>\n<p>Here are a few questions \u2013 and additional resources \u2013 to help you narrow down which tax filing status might be the most advantageous for you.<\/p>\n<h2><strong>Are you married?<\/strong><\/h2>\n<p>Really, this question is: Are you married or considered married on the last day of the year? Or are you unmarried or considered unmarried on the last day of the year?<\/p>\n<p>That\u2019s a lot of \u201cor\u201d. Here\u2019s the deal. If you\u2019re married and living together, then you\u2019re married! (We hope that\u2019s not a surprise.)<\/p>\n<p>You&#8217;re also married for tax filing status purposes if:<\/p>\n<ul>\n<li>You\u2019re living together in a common law marriage recognized by the state you live in, or by the state where the common law marriage began.<\/li>\n<li>You\u2019re married and living apart, but not legally separated.<\/li>\n<li>You\u2019re separated under an interlocutory (not final) decree of divorce.<\/li>\n<\/ul>\n<p>If you meet any of those criteria, you can choose to file as married filing jointly or <a href=\"https:\/\/www.hrblock.com\/tax-center\/irs\/tax-responsibilities\/marriage-tax-penalty\/\">married filing separately<\/a>\u2026<\/p>\n<p>UNLESS you accepted a premium tax credit under the Affordable Care Act. If that&#8217;s the case, you need <a title=\"The Affordable Care Act\u2019s Premium Tax Credit and Your Filing Status\" href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/credits\/dont-lose-the-advance-premium-tax-credit\/\" target=\"_blank\" rel=\"noopener noreferrer\">to file as married filing jointly<\/a> in order to receive the credit.<\/p>\n<h2><strong>Should you file jointly or separately?<\/strong><\/h2>\n<p>That&#8217;s up to you. Couples typically find that it is <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/personal-tax-planning\/married-filing-jointly-first-time\/\" target=\"_blank\" rel=\"noopener noreferrer\">most advantageous to file jointly<\/a>.\u00a0However, there are many good reasons to file separately, as well. You should speak with a tax professional if you think some of those reasons might apply to you.<\/p>\n<p>Now there\u2019s the flip side of the coin: unmarried. If you haven\u2019t ever been married, then it\u2019s easy to say that you\u2019re filing status is unmarried.<\/p>\n<p>If on the last day of the year you\u2019re legally separated from your spouse under a final divorce or separate maintenance decree or if you have a court decree of annulment, then you\u2019re considered unmarried for tax purposes. If you obtained an annulment and filed as married in prior years, then you\u2019ll need to amend those earlier returns.<\/p>\n<h2><strong>If you are unmarried<\/strong><\/h2>\n<p>There are two filing statuses in this category \u2013 single and head of household. So there are a few more questions to ask.<\/p>\n<h2><strong>Do you have kids?<\/strong><\/h2>\n<p>If the answer is no, your filing status is likely single. UNLESS\u2026<\/p>\n<h2><strong>Did you maintain a household for a qualifying child or a qualifying relative?<\/strong><\/h2>\n<p>If the answer is yes, your filing status is likely head of household. Be careful though. Head of household can be a tricky one. First, you need to have paid more than half the cost of maintaining a household for the year \u2013 and you can\u2019t include just anything in that calculation. It specifically looks at rent, mortgage interest, real estate taxes, home insurance, property taxes, repairs, utilities, and food eaten in the home. Then, you must have had a qualifying child or relative who lived with you for more than half the year and you can claim as a dependent.<\/p>\n<p>Read <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/personal-tax-planning\/what-is-head-of-household-status\/\" target=\"_blank\" rel=\"noopener noreferrer\">all about Head of Household<\/a> status and who can be a qualifying relative.<\/p>\n<p>Filing as head of household lets you claim a larger standard deduction and reduces your taxable income.<\/p>\n<h2>The fifth filing status &#8211; qualifying widowe(er)<\/h2>\n<p>If your spouse died in 2024 and you didn\u2019t remarry, you must use married filing jointly or married filing separately on your return. You\u2019re considered married for the entire year. For up to two years after the death of your spouse, if you don\u2019t remarry and have a dependent child, you can use the qualifying widow(er) filing status.
